(Columbus) - Without comment, the Ohio Supreme Court has declined to hear an appeal from former Akron Police Captain Douglas Prade. Convicted in the 1997 murder of his wife, Prade was freed from prison in January 2013 when Summit County Common Pleas Judge Judy Hunter ruled that the presence of someone else's DNA on the victims clothing put Prade's conviction in doubt. That ruling was later reversed by the Ohio Appeals Court. With today's decision by the state's highest court not to hear the case, Summit County Prosecutor Sherri Bevan Walsh will ask a court to order that Prade be returned to prison. A hearing is set for Friday afternoon.
